1) SALE CONTRACT

  1. When you order any product or service your contract with us will commence when we, Blue Tree Services, confirm acceptance of your order.
  2. These Terms and Conditions shall govern the contract to the exclusion of any other terms and conditions.
  3. Variations to these Terms and Conditions may from time to time be made available on the website.

2) ORDERING

In submitting an order you acknowledge that:

  1. All information and specifications relating to the services provided are approximate and Blue Tree Services is not responsible for the accuracy of content provided.
  2. Blue Tree Services may make any changes to the specification of the services to conform to any statutory or European requirements.
  3. You accept the terms and conditions of the sale as set out by Blue Tree Services

3) PRODUCT DESCRIPTION

  1. We make our best endeavours to be as accurate as possible. However Blue Tree Services does not warrant that descriptions of products or services are accurate complete reliable current or error-free.
  2. Blue Tree Services does not warrant the accuracy of any information provided by its products and does not guarantee any of the services supplied by third parties which are integral to the workings of Blue Trees products.
  3. Alarms which activate an SMS are free to the client for the first 50 sms’ each calendar month. The 51st sms and subsequent sms triggered by alarms are charged to the client at 25p per sms.

4) PRICING POLICY

  1. The price of the products or services shall be the price as quoted by Blue Tree Services on the date the order was placed, subject to any inadvertent pricing errors (whether technical or otherwise) by Blue Tree Services. If the stated price is an error Blue Tree Services will give you the opportunity to withdraw your order before accepting it.
  2. The price of the products or services includes any applicable Value Added Tax, which you shall be liable to pay to Blue Tree Services.

5) ROAMING

  1. If the tracking units are used outside of the UK, the roaming charges for data in other countries as well as the Blue Tree Services administration fee will be charged to you.
  2. Please contact us to enable roaming.

6) PARENT UNIT USE OF DATA CARD

  1. The BlueMap parent unit has a data sim which is designed for tracking only. If you use the BlueMap for data other than tracking, the extra data will be charged to you as well as Blue Tree Services administration fee.

7) CREDIT CARDS

  1. Credit and debit cards accepted by Blue Tree Services Limited are Visa, Mastercard, Amex.
  2. All payments by credit or debit cards will be taken prior to delivery of the services. Any fraudulent use of credit or debit cards will be notified to the authorities along with any identification details supplied with the order.
  3. Any refund made to your credit or debit card shall be subject to the terms and conditions of the relevant issuing bank and therefore be subject to any time delay as specified by the issuing bank. We will not be liable for any delay that is outside our control.  A correct cardholder name and address must be supplied at the time of ordering where it is different from your name and address.

8) DELIVERY

  1. If you do not take delivery of the services or give Blue Tree Services Limited adequate delivery instructions we shall not be liable for failure to deliver services or product.
  2. If you do not receive what you ordered in full either training content, product or service, as specified on your original order then you must notify Blue Tree Services Limited within 14 working days from the date of delivery.
  3. Risk of loss and title in the services will pass to you on delivery to the address stated on your order.

9) RIGHT OF CANCELLATION

You have the right to withdraw from the contract at any time after we have accepted your order until 7 working days before the service is due to be delivered. In the case of data contracts this is not subject to cancellation after the order is signed.

10) WARRANTY

Subject to clause 13 below Blue Tree Services Limited warrants that the services will correspond with the order at the time of delivery. If Blue Tree Services Limited is in breach of this warranty you shall notify Blue Tree Services Limited within 14 working days from the date of discovery of the defect. On receiving a notice of failure of warranty Blue Tree Services Limited may, at its sole option either supply the product or service again or refund the price of the product or service.

11) EXPORT TERMS

Blue Tree Services Limited will be responsible for complying with any legislation or regulation governing the importation of services into the country of destination.

12) WITHDRAWAL OF SERVICES

Blue Tree Services Limited may withdraw any product or service without prior notice, or liability, to you.

13) COPYRIGHT

All material included on our site or within our product or services including but not limited to graphics, logos, icons, text and software is the property of Blue Tree Services Limited and is protected by UK and international copyright laws.

14) ACCESS TO THE WEBSITE

Blue Tree Services Limited grants you the right to use its website for your business or personal use but not to download or modify it or any part of it except with our prior written consent. This licence does not include any resale or commercial use or derivative use of the website or its contents. No part of the site may be used for commercial purposes without the express written consent of Blue Tree Services Limited or through participation in an affiliate scheme authorized by Blue Tree Services Limited.

15) DISCLAIMER AND LIABILITY

  1. The products and services provided by Blue Tree Services Limited are on an "as is" basis. We make no representations or warranties of any kind express or implied as to their operation or the information content included. You agree that your use of these products and services is at your sole risk.
  2. Except as specifically stated on the website, to the full extent permissible by applicable law Blue Tree Services Limited disclaims all warranties express or implied including but not limited to implied warranties of satisfactory quality or fitness for a particular purpose. This does not affect your statutory rights.
  3. Blue Tree Services Limited does not warrant that this website its servers or e-mail sent from Blue Tree Services Limited are free from viruses or other harmful components.
  4. Blue Tree Services Limited will not be liable for any damages of any kind arising from the use of its products or services including but not limited to damages for consequential loss where such losses were not foreseeable to both parties when the Contract was made or where such losses were not caused by any breach by Blue Tree Services Limited. Blue Tree Services Limited excludes liability for any losses to any parties including but not limited to loss of profit, business or economic loss.

16) GENERAL

  1. If any provision of these Terms and Conditions is held by any competent authority to be invalid or unenforceable in whole or in part the validity of the other provisions of this Agreement and the remainder of the provision in question shall not be affected thereby.
  2. Failure or neglect by Blue Tree Services Limited to enforce at any time any of the provisions of these Terms and Conditions shall not be construed nor shall be deemed to be a waiver of its rights under these Terms and Conditions nor in any way affect the validity of the whole or any part of these Terms and Conditions nor prejudice Blue Tree Services Limited rights to take subsequent action.

THIS DOES NOT AFFECT YOUR STATUTORY RIGHTS.

17) APPLICABLE LAW

The Contract and these Terms and Conditions shall be subject to English law and the parties submit to the non-exclusive jurisdiction of the English Courts.
